Extension of Time for filing of 45 Comapny E-Forms

EXTENSION OF TIME FOR FILING OF 45 COMPANY E-FORMS, PAS-03 AND SPICE+ PART-A IN MCA-21 V3 Portal WITHOUT ADDITIONAL FEES. 

1. Ministry of Corporate Affairs has recently launched its Version 3.0 which has changed the way of filing, due to which professionals are facing various problems in filing of e-forms including fresh process of registration of users and stabilization of 45 e-forms which was launched on V3 with effect from 23.01.2023. For seamless flow of process, the MCA after weighing various representations it has been decided to allow further additional time till 31.03.2023 for filing of these forms which are due for filing between 07.02.2023 to 28.02.2023 without any additional fees.

2. Earlier, Form PAS-03 was also closed for filing in V2 Version on 20.01.2023 and thereafter launched on V3 on 23.01.2023. Therefore, stakeholders whose due date of filing falls between 20.01.2023 to 28.02.2023 can file form till 31.03.2023 without levy of any additional fees.

3. Further, the resubmission period under Rule 9 of Companies (Incorporation) Rules, 2014 which falls between 23.01.2022 and 28.01.2022 is also extended by 15 days and reservation period for names under sub-section (5) of Section 4 of the Companies Act,2013 is further extended by 20 days.

4. Extension of time will enable professionals and stakeholders for easier migration to newly launched portal and will provide relief from cost of non-compliance.
